Good point. Let me rephrase part of the regulations: "If a perceived
offender and the list owner cannot come to an agreement, than arbitration
by the board of appeal will take place. The perceived offender requests
arbitration and (s)he discloses the discussion so far to the board of
appeal or asks the list owner to do so."
